SPCT proposes opening a service to patients affected by medical malpractice (12/09/2013)

In recent weeks we have known at least 2 cases of patients of the Hospital of St. Lucia who report alleged medical negligence.

In these cases, patients who are affected are in a maze of obstacles in order to know the causes of each of their cases.

Trying to know how many deaths are in Spain for medical errors or deficiencies in health care is mission impossible.

While in the United Kingdom have conducted five investigations to clarify this scandal malpractice deaths in the last decade in Britain, and the United States has created the Committee on Quality of Healthcare in America (according to which each year occur in this country between 48,000 and 98,000 deaths due to negligence), in Spain there is a record or a count of these events.

In Spain, the only approach that we have these memory data is offered every year by ADEPA (Patient Advocacy Association).

According to the last one, in 2012 killed 692 people for alleged medical negligence, 89 more than in 2011.

According to their data: The most common cases have occurred malpractice: interventions poorly made, substandard care, hospital infections, delays in ambulances ...

But the main reason is due to error diagnosis and therapeutic opportunity loss due to the lack of resources for health cuts

Although according to the same association, the number is much higher, and there are studies claiming that there are more deaths from medical negligence by traffic accidents in Spain.

Also according ADEPA only 40% of the complaints that come to them, they end up in court.

This low incidence is mainly due either to the lack of financial means, aggravated by rising legal fees, either because they lack many data on medical history, due to the lack of transparency of the system itself.

Since we consider SPCT give a quick answer, transparent and fair by the Murcia Health System to cases inevitably due to the large volume of patients seen, there are help to improve the quality of service.

Our public health system, despite the attacks that are suffering from the PP government, has an excellent team composed of medical staff, administration and service, which works daily with great professionalism to give the best services to patients, despite the difficulties and cutbacks.

But as in all employment sectors undoubtedly errors sometimes occur, which in this case because of its importance produce some alarm.

So we think that the Public should be an ally of patient and professional to offer a service that can defend fairly with both parties to an alleged case of negligence.

So from our political propose the implementation of a Service to Medical Malpractice Patients affected within the system, which effectively treats medical negligence occurring in any public or private health facility.

This service would be obliged to report and provide all documentation requested by the patient clinic when a claim is filed, reports essential for a patient suffering a reliable way to know the reality of his case, without which it is difficult to succeed a legal claim.

In the same vein we really need to know from the inpatient hospital entry to your rights, channels of information request, as well as the operating rules of the center itself, both as to duties rights and we need editing a Patient Care Guide that provide information of the same and that also protects professionals irresponsible behavior of users.

Finally we think this service in addition to an element of quality of care, can be a useful tool to save costs to the public health because if proven errors be shamed and often expensive to the public purse.
