MC claims that the file be promoted so that the director of the Legal Department chooses between his public and private activity and returns the more than 200,000 euros received in excess (01/05/2019)

MC Cartagena will present a motion to the municipal plenary on May 10th so that the mayor is urged to, in compliance with his duties and as responsible, promote the compatibility files of the director of the Legal Department and the director of Public Employment, New Technologies and Innovation.

The motion states that "in the case of the director of the Legal Department he is asked to choose between his public and private activities, requiring him, in any case, the return of 210,083.12 euros, except for error or omission, has been able receive in excess of specific complement ".

The Director of Public Employment, New Technologies and Innovation is requested to carry out the necessary procedures for its regularization, including the economic one where appropriate.

Likewise, it is demanded that "the complete file be transferred to the Cartagena Area Prosecutor's Office in case the continued concealment of his work in the private sector by the director of the Legal Department and, in particular, his statements affirming that his activity corresponds to the public university, were constitutive of crime ".

The mayor of the Cartagena training, María José Soler, recalled that "already last January, our Group requested the General Secretariat of the Plenary to report on the work outside the City Hall of the director of the Legal Department and the director of Public Employment, New Technologies and Innovation, to clarify if their external activities are considered to be legal. "

Likewise, "we are interested in knowing if the compatibility recognized both years ago as civil servants is valid, not as a directive organ, for teaching in public universities".

Soler added that "after requiring this documentation, it has been proven that both have carried out a teaching activity outside the City Council, in the case of the director of Public Employment, New Technologies and Innovation in the public university and, eventually, in a private center; while the director of the Legal Department has kept her, at all times, in a private center, with which she also has an indefinite part-time contract ".

Specifically, he explained that "the conclusions reflect that the director of Public Employment, New Technologies and Innovation has breached the compatibility rules for not requesting it to the Plenary since it was appointed as such on September 14, 2018, although it is possible grant it to be a public center as long as it meets the salary limits, report favorably the rector and approve the Plenary.

Likewise, it specifies that "the director of the Legal Counsel violates the standards of compatibility from, at least, April 14, 2014, when he was appointed to the position he holds, and that provides labor services to a company and not to a public university center, as reaffirmed when required in March 2016. In addition, he affirms that due to his large salary he is incurred in a cause of incompatibility of remuneration ".

In this sense, the maximum limit for a specific supplement would have to be 353.12 euros, while currently it receives 3,196.69 euros.

Regarding the director of the Legal Department, the data indicate that he could have received 2.659,28 euros per month more since May 2014, which means, except error or omission, 210,083.12 euros, taking into account that 14 annual payments are received .

It should be remembered that, in March 2016, clarification was requested and he did not make it, a statement that "we understand could even constitute an offense even though it is not up to us to typify it", said María José Soler.
