José López celebrates that the initiative of the MC Heritage coordinator, María Dolores Ruiz, allows free visits to the BICs to be assured (12/10/2018)

Last Monday, the Plenary of the Regional Assembly approved the modification of the Law of Cultural Heritage of the Autonomous Community in order that the owners of the BIC allow to visit, at least four days a month, these properties for free.

This initiative has been approved by the Autonomous Community at the request and initiative of the MC Heritage coordinator, María Dolores Ruiz, María Dolores Ruiz, a well-known activist in defense of the heritage of Cartagena and the Comarca, both personally and in different associations or entities in which militates or has militated as the Association of Friends of the Monastery, ADEPA, DAPHNE, Monte Miral and the Virgen de la Caridad Platform.

The general secretary of MC, José López, said that "from our formation we celebrate that the initiative transferred by María Dolores Ruiz to the Regional Assembly has allowed the modification of the Cultural Heritage Law of the Region so that the owners of the property of cultural interest allow the visit to them during at least four days a month ".

López has shown that "once again, the tireless work of María Dolores Ruiz, Heritage coordinator of our training, bears fruit and, in this case, will oblige the regional government to demand the owners of the goods of cultural interest. to conserve and protect monuments or buildings cataloged as BIC so they can be visited. "

In the opinion of the Cartagena leader, "a new period opens in which there are no excuses for the citizens of this Autonomous Community to know, for free, part of the collective history of this Region. , the time comes for the adaptation and the enjoyment of real estate such as the Cathedral, Villa Calamari or the Casa del Tío Lobo ".

Normative

The Law 16/1985, of June 25, of the Spanish Historical Heritage, includes in article 13.2 that the owners and, where appropriate, the holders of real rights over such property, or whoever owns them by any title, are obliged to allow their public visit, under the conditions of gratuity that are determined by regulation, at least four days a month, in days and hours previously indicated.

The initiative of María Dolores Ruiz seeks to find a regulation of regional regulations in accordance with the state and the principles of the Spanish Constitution, as not guaranteeing free public visit at least four days a month conflicts with articles 9 and 44 of the Spanish Constitution of 1978, by not ensuring the participation of all citizens in cultural life and not protecting access to the culture to which we are all entitled.

Likewise, Ruiz requests the institution of the Ombudsman to remind the regional administration of the legal duty to ensure that all citizens can have access to the BICs in conditions of free of charge a minimum of four days a month in accordance with the constitutional spirit.
