Justice confirmed a complaint file against ANSE for alleged damages in an action in favor of salt Marchamalo (22/10/2009)

. The Audiencia Provincial de Murcia (Section Cartagena) dismissed the appeal filed by the company Salinas de La Manga (owned construction companies Alfonso Garcia and Mariano Roca) against the Order of the Court of Instruction No. 5 of Cartagena (dated March 16, 2009) which decreed the provisional dismissal of the complaint proceedings against members of ASEAN who protested in August 2007 by the abandonment of salt.

The Court justifies its decision not to meet any of the cases to consider the facts as a criminal offense, and demonstrated the abandonment of salt mining.

And ratifies the decision of the judge, that "After the many steps taken in any way has proved successful in this stage of the proceedings that the defendants caused damage that these were intentional, or the amount or value of the alleged damages."

The Association held in August 2007 a protest by the malfunction of the salt, with abandonment of some of the ponds and salt extraction missing for years, it has had on several occasions the death of many fish.

ANSE Members then proceeded to the collection by manual means of a small mound of salt, to vindicate the dreadful state of the salt, which does not "harvest" continuously salt for years, although owners received a grant from the Autonomous Region for their maintenance.

Although participants in the action chosen one of the most damaged ponds of salt, the owners of these presented a report "false" on alleged damages of € 3,000.

It appears at least curious that despite this complaint against ANSE, not collected last summer salt.

The 6 members of ANSE repeatedly reported that the action was carried out with absolute respect to the salt plant, denying that the damage that the owner intended to impute were made during the protest action, but were, in fact, the poor state impairment who have for years.

Indeed, after repeated complaints about the failure ANSE of the collaboration between the company and the Autonomous Community, both organizations decided to terminate the collaboration agreement "by mutual agreement."

The budgets of the Autonomous Region for 2008 (Ministry of Sustainable Development and Planning), watched a game of 40,000 € for a collaboration agreement with the company Salinas de La Manga, SL for the "maintenance of the salt industry in Space Sheltered from the Salinas de Marchamalo, their monitoring and conservation work, in order to maintain populations of Aphanius iberus and waterfowl. "

Only recently the Director General of Natural Heritage and Biodiversity of the Autonomous Community has recognized the failure of the collaboration agreement, regarding maintenance of the salt industry, but is yet to respond to allegations of ANSE.
