Legal problems prevent suspend the privatization of CAI New Cartagena (14/07/2015)

Although the new government team is committed to governance, the Councillor for Education sees no alternative legal and margin or to suspend the procurement process initiated by the previous government

The Councillor for Education, David Martinez Noguera, said that the City of Cartagena has acted according to what makes the laws in the process of awarding the Center for Child Care (CAI) New Cartagena.

The new administration, which assumed the municipal administration on 13 June, has encountered numerous legal problems in stopping the contest because the process is in the final phase of the award open by the previous team municipal government.

The City has not had time margin, or operating option, or suspend legal alternative because the process could generate a significant economic burden stop municipal coffers since the Autonomous Community could claim the City more than 1 million euros for the grant initially awarded for the construction of the center, said Martinez Noguera.

The council also warned that the suspension of the competition, once published in the BORM and in the last phase of implementation, could have caused an extremely serious legal problem for the City Council would have had to cope with the demands of the five companies and a high cost in compensation for breaking the bases set out in the specification for the privatization of the CAI.

The mayor of Education has said that the commitment of the government team will always be the public management of municipal nursery schools and not the privatization model implemented in previous legislatures in the municipality and the corresponding current management CAI contest New Cartagena.

From the Department of Education highlighted that despite being against the private management of the center, before the start of the school and to the limited discretion to recognize that opening the CAI lead to the creation of 148 squares to serve children between 0 and 3 years as required in the area of reference population.

Finally, David Martinez Noguera said that this measure involves an act of responsibility to the educational needs of the municipality and the company who will assume the cost of implementation, equipment and furniture installations.

Since the government team said that they are already working on the progressive expansion of municipal nursery schools in addition to the r eview of scales for deductions and allowances for families with less income.
