"The courts investigate Castejón for the violation of the fundamental rights of MC councilors" (12/02/2018)

The spokesman of the MC Cartagena municipal group and general secretary, José López, has announced this morning that "the Contentious Court has admitted to process the complaint against Ana Belén Castejón for the violation of the fundamental rights of the councilors of MC in the Governing Board of December 29, in which he wanted the councilors of this formation to vote on that supposed resolution to change the rates of Hidrogea without knowing the proposal. "

"Ms. Castejón is already being investigated for the Administrative Litigation for the violation of the fundamental rights of the councilmen of her Government, to whom she did not give them the necessary documentation to be able to vote accordingly," he summarized.

After this situation, Lopez has indicated that it is expected that "the judge paralyze or annul the decision that was taken in that Governing Board because it was not in accordance with the law, the representatives of citizens can not reach a vote of a Government Board without knowing the resolutions on which they have to comment or vote, and that is what Ana Belén Castejón tried to do on December 29. "

Chronology

On December 29, 2017, during the session of the Governing Board, the mayor imposed with its quality vote the approval of a water tariff revision agreement, which had been introduced in violation of the rules on the agenda. December 28th.

The councilors of MC warned the day before and the same day of the irregularities, requesting that they be made available the file to know before voting, to which the Mayor refused, approving a record of more than 40 million euros processed in two days and hidden half of the municipal government.

The councilors of MC belonging to the Governing Board, Francisco Calderón, Ricardo Segado and María José Soler, appealed to the Court to recognize this violation of their constitutional right, included in art.

23.1 of the Spanish Constitution, to know the matters in which it has to vote, which was opposed by the City Hall forcing the Judge to hold a hearing last week.

At the hearing, held on Tuesday, February 6, the Judge listened to both parties and the Prosecutor's Office, which acceded to the request of the councilors to investigate the actions of Castejón and the PSOE, today being notified of the order confirming the continuation of the procedure despite the City Council's attempt to close it in fake.

Specifically, it will be investigated whether Ana Belén Castejón, with her accelerated two-day procedure, the imposition of her agreement and the concealment of the file, has violated this constitutional right.

The councilors of MC will contribute, through their procedural representation, the proofs that prove the violation, and trust that the courts offer the protection against the arbitrariness and imposition of Castejón.

It should be noted that until it has been sent to the Court, the councilors of MC have not known the file, and that the announced drop, a month and a half later, has not entered into force or is known if it is being processed.
