The Court rejects the appeal against the adjudication process of the bars (17/05/2017)

The Central Administrative Tribunal of Contractual Resources, at its meeting on 05/12/2017 and in relation to the record of the appeal filed against the notice and the bidding documents of the chiringuitos in Cartagena, has rejected this appeal.

The resolution is final in the administrative court and against it it is possible to file a contentious-administrative appeal before the Administrative Court of the Superior Court of Justice of Murcia, within a period of two months, from the day following the receipt of the notification.

Likewise, the judicial decision states that "even though the contract, insofar as the City Council establishes the typology, uses and conditions of seasonal services, could be qualified as a concession of services, its estimated value is notoriously below 5,225. 000 euros, so it is not subject to harmonized regulation and, therefore, its decision does not correspond to this Court ".

The Court also argues that it is inadmissible to admit the action, "since it refers to a contract not subject to special appeal and the decision, therefore, does not correspond to this Court."

The Councilor for Tourism, Obdulia Gómez, expressed her satisfaction with this decision and stated: "We were convinced that the resolution was going to be in this sense since we have done well, within the legality and allowing free competition."

Likewise, Gomez has indicated that if the resources had not been presented "the chiringuitos would have opened in Easter".

Therefore, the award process can be concluded shortly.
