The City of Cartagena will appeal in cassation judgment for the land of the former barracks of La Azohía (28/06/2018)

The City of Cartagena will first ask the Superior Court of Justice (TSJ) of the Region of Murcia to clarify the sentence condemning the session to the payment of an indetermination to the promoter companies for the cancellation of a license for the construction of apartments in The Azohía;

to then appeal in cassation to the Supreme Court, as pointed out by the spokeswoman of the Municipal Government, Obdulia Gómez.

The spokeswoman explained that after hearing the court ruling, the City of Cartagena is already studying the way forward to safeguard the interests of citizens, "which in any case will happen by immediately presenting an appeal for clarification of the sentence before the TSJ. "

Similarly, he stressed that "if there is a basis, that everything indicates that this is the case, the Consistory will present an appeal for cassation before the Supreme Court."

Gómez, has appeared this morning before the media to make an assessment on the court ruling that has been known this Thursday in which the Superior Court of Justice (TSJ) of the Region of Murcia has dismissed a municipal resource and has confirmed in full the sentence of the Court of the Contentious Administrative 1 of Cartagena that condemned to the Consistory to pay 3,4 million euros to two companies, for having annulled the license of construction of 24 tourist apartments in the Azohía and to have changed the classification of the plot of Private to public.

Therefore, Gómez has indicated from the City of Cartagena will exhaust all judicial channels "to try that the mismanagement of Segado (then councilor of Urbanism) and the Government of the Popular Party do not cost the citizens of Cartagena a whopping 4 million of euros".

According to the ruling issued today by the TSJ, the City of Cartagena must compensate two merchants: Apartamentos Turísticos La Azohía SL and Bulevar Infante SL to the amounts of 3,189,315.91 and 239,111.38 euros, respectively.

To these amounts should be added the costs of the procedure and the interest generated during these years, so that the amount may exceed 4 million euros.

This patrimonial claim was filed by both companies on June 6, 2014, as recalled by the spokesperson of the municipal government, Obdulia Gómez, being councilor of Urbanism Francisco Espejo, of the Popular Party.

Also, according to the spokeswoman of the Government, the claim is the result of a decision made by Joaquin Segado, current president of the Popular Party and the Port Authority in Cartagena, who in his time as town councilor of Urbanism- when Pilar Barreiro was in front of the Cartagenero Consistory- authorized the change of use, from private to public, of the plot of the old civil guard barracks in La Azohía.
